Terms of Service

1. Agreement to terms

By creating an account or using Vestry, you agree to these Terms of Service. If you do not agree, please do not use Vestry. These terms apply to all users of the platform, including landlords and tenants.

2. What Vestry is

Vestry is a property management platform that helps landlords manage their rental properties, communicate with tenants, track rent payments, and handle maintenance requests. Vestry provides software tools only — we are not a real estate agency and we do not manage properties on your behalf.

3. Your account

When you create an account with Vestry, you agree to:

• Provide accurate and complete information
• Keep your login credentials secure and not share them with others
• Be at least 18 years of age
• Notify us immediately at vestrysupport@gmail.com if you believe your account has been compromised

You are responsible for all activity that occurs under your account.

4. Acceptable use

You agree not to use Vestry to:

• Violate any laws or regulations
• Provide false or misleading information
• Harass, abuse, or harm other users
• Attempt to gain unauthorised access to any part of the platform
• Use Vestry for any purpose other than property management

We reserve the right to suspend or terminate accounts that violate these terms.

5. Payments and subscriptions

Landlord subscriptions:

• Subscriptions are billed monthly and renew automatically
• You can cancel your subscription at any time from your account Settings
• Subscription fees are non-refundable, including for partial months

Rent payments:

• Rent payments are processed by Stripe, our third-party payment provider
• A transaction fee may apply to online rent payments
• Vestry is not responsible for payment disputes between landlords and tenants

6. Your content

You retain ownership of any content you upload to Vestry (such as documents, photos, and messages). By uploading content, you grant Vestry a limited licence to store, display, and transmit that content as necessary to provide the service. You are responsible for ensuring you have the rights to any content you upload.

7. Vestry Marketplace

Platform only — not a real estate agent

Vestry Marketplace is a software platform that connects landlords and prospective tenants. Vestry does not act as a real estate agent, property manager, broker, or intermediary. All rental agreements, negotiations, and transactions are conducted directly between landlords and tenants. Vestry is not a party to any rental agreement and accepts no responsibility for disputes between landlords and tenants.

Listing fees

Landlords pay a flat fee of $50 AUD to post a property listing on Vestry Marketplace. This fee is non-refundable once a listing has received one or more applications. Refunds are available within 24 hours of posting if no applications have been received, by contacting vestrysupport@gmail.com.

Anti-discrimination policy

Landlords using Vestry Marketplace must comply with all applicable anti-discrimination laws, including but not limited to the Racial Discrimination Act 1975, Sex Discrimination Act 1984, Disability Discrimination Act 1992, Age Discrimination Act 2004, and relevant state and territory legislation. Listings must not discriminate against applicants based on race, ethnicity, nationality, gender, pregnancy, disability, religion, age, family status, sexual orientation, or any other protected characteristic. Vestry reserves the right to remove any listing that violates this policy without refund.

Landlord responsibilities

Landlords are solely responsible for:

• Ensuring their listing is accurate and not misleading
• Complying with all applicable tenancy laws in their jurisdiction
• Lodging bond with the relevant state authority (e.g. RTBA in Victoria, NSW Fair Trading)
• Preparing and executing lease agreements in accordance with local laws
• Conducting their own due diligence on prospective tenants

Tenant responsibilities

Tenants are solely responsible for:

• Ensuring information provided in their profile and applications is accurate and truthful
• Conducting their own due diligence on properties and landlords before entering any agreement

Reviews

Landlords may leave reviews for tenants they have previously rented to. Reviews must be honest, accurate, and not defamatory. Vestry reserves the right to remove reviews that are false, misleading, or in violation of these Terms. Vestry does not verify the accuracy of reviews.

Reporting

Users may report listings, profiles, or reviews that violate these Terms by contacting vestrysupport@gmail.com. Vestry will investigate reports and take appropriate action, which may include removing listings or suspending accounts.

No guarantee of tenancy

Vestry does not guarantee that landlords will find a tenant or that tenants will secure a property through Vestry Marketplace. Listing fees are charged for access to the platform, not for guaranteed outcomes.

8. Tenant data

If you are a landlord using Vestry to manage tenant information, you are responsible for ensuring you have a lawful basis for collecting and processing your tenants’ personal data. Vestry provides tools to facilitate this — the responsibility for legal compliance remains with you.

9. Availability and changes

We aim to keep Vestry available at all times but cannot guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the service at any time. Where possible, we will provide advance notice of significant changes.

10. Limitation of liability

To the maximum extent permitted by law, Vestry is not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability to you for any claim arising from these terms or your use of Vestry will not exceed the amount you paid to Vestry in the three months preceding the claim.

11. Disclaimer

Vestry is a software platform, not a real estate agent, legal adviser, or financial adviser. Nothing on Vestry constitutes legal, financial, or property management advice. You are responsible for complying with all applicable tenancy laws and regulations in your jurisdiction.

12. Termination

You may close your account at any time. We may suspend or terminate your account if you breach these terms, with or without notice. Upon termination, your right to use Vestry ceases immediately. Provisions that by their nature should survive termination (such as limitation of liability) will continue to apply.

13. Governing law

These terms are governed by the laws of Victoria, Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

14. Changes to these terms

We may update these Terms of Service from time to time. We will notify you of significant changes by email or by displaying a notice on the platform. Continued use of Vestry after changes are made constitutes acceptance of the updated terms.
